New Twist in Child Maintenance Case as Sabastian Magacha Opposes Ex-Wife’s Demands

Sabastian Magacha has responded to ex-wife’s  maintenance application by filing a Notice of Opposition with the Maintenance Court for Mashonaland Province Case Number M5009/25 and thus adding another chapter in an ongoing battle over financial responsibility of raising their child together.

Magacha filed his Notice of Opposition through Nyamwanza Legal Practice to state his intention of opposing Senderayi’s application on grounds detailed in an attached affidavit.

According to Magacha’s legal representations at Nyamwanza Legal Practice, Magacha asserts his intent of opposing her application on these grounds: contributions towards upkeep have been provided since 2024, but ex-wife refused to accept them; further, Ex-wife  attempted to force herself upon him while leading an extravagant life which caused financial strain which Magacha could never afford; in contrast, Magacha claims to live within means.

The child mother  made various claims regarding her financial responsibilities towards their child’s education; Magacha maintained he secured their daughter a place at Blakiston Junior School where school fees reportedly run approximately USD$90 per term.

However, Magacha’s ex-wife expressed concern that such change might further hamper development, particularly given previous transfers.

Magacha emphasizes in his defense that maintaining a minor child is the responsibility of both parents, with contributions made according to their financial capacity. Magacha believes he has fulfilled his responsibilities but asserts that ex-wife has rejected his attempts for assistance, such as school fees.

 

Magacha responded to ex-wife’s application by filing an opposing affidavit that revealed his financial constraints; in it, he claimed that higher contributions demanded by her were beyond his means, regardless of his professional engagements and public performances.

Child mother  has asked the court to intervene, seeking an order compelling Magacha to contribute USD$250 each month towards Magacha’s maintenance costs for their child, such as school fees, food, clothing, etc.
